XtrkR is operated by De Nihil LLC, a Wyoming limited liability company. In these terms, "I" refers to De Nihil LLC.
By downloading, installing, or using XtrkR ("the App"), you agree to these terms. If you don't agree, please don't use the app.
XtrkR is a personal sexual health tracking application. It helps you log encounters, track medication adherence (PrEP, DoxyPEP), record STI test results, monitor vaccinations, and view health insights — all stored locally on your device.
XtrkR is not a medical device, diagnostic tool, or substitute for professional medical advice.
Always consult a qualified healthcare provider for medical decisions. If you think you may have a medical emergency, call your local emergency services immediately.
All data you enter into XtrkR is stored locally on your iPhone. I do not have access to your data, and I cannot recover it.
XtrkR offers a free tier and multiple paid options. All purchases are processed by Apple through StoreKit and are subject to Apple's Standard EULA and the Apple Media Services Terms. I do not receive or store your payment information.
Refunds. Core purchases, Wrapped purchases, and tips are subject to Apple's standard refund policy. I do not process refunds for these purchases independently. For XtrkR+ subscriptions, if you request a refund within 30 days of any renewal charge, I will work to ensure you receive a pro-rata refund for the unused portion of your subscription period. Because Apple controls subscription billing, this may be fulfilled by restoring access to a complimentary period rather than a direct monetary refund. Pricing. Prices may change for new subscribers. If you hold an active XtrkR+ subscription, your renewal price will not increase for as long as your subscription remains continuously active. This commitment does not apply if Apple discontinues the product tier, if XtrkR is discontinued entirely, or if a change in applicable law or App Store policy requires a pricing adjustment. Current prices are always displayed in the App Store before purchase.
Auto-Renewal Disclosures. Your XtrkR+ subscription renews automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time through Settings > Apple ID > Subscriptions on your device. Cancellation takes effect at the end of the current billing period. No cancellation fees apply.

XtrkR is rated 17+ on the App Store due to mature health content. To use XtrkR, you must be at least 18 years old. On first launch, the app will prompt you for your date of birth and will not unlock until you reach 18.
You agree not to use XtrkR for unlawful purposes, to reverse-engineer or redistribute the app, to store data on behalf of others without consent where consent is required, or to misrepresent health insights, reminders, or other app outputs as medical advice, diagnoses, or treatment recommendations. You also agree not to use XtrkR to store unlawful content, including nonconsensual intimate images or images of minors.
XtrkR's design, code, icons, and content are protected by copyright. Your data belongs to you — XtrkR claims no ownership over any data you enter.
XtrkR does not host content uploaded by users. Photos, notes, attachments, and any other media you add to the app are stored on your device. I do not operate servers that hold this content, and I do not have the technical ability to view, search, retrieve, or remove content stored on your device.
If you store content in XtrkR that you do not own or do not have the right to use, that is a matter between you and the rights holder. As stated in Acceptable Use, you agree not to use XtrkR to store unlawful content, which includes content that infringes the copyright of others. Copyright holders concerned about specific content stored on a user's device should pursue the matter directly with the user or through applicable legal process. Because the content does not pass through or reside on my servers, I am not in a position to act as an intermediary or to remove user-stored content on a copyright holder's behalf.
This section is informational. It is not a designation of an agent under 17 U.S.C. § 512(c). XtrkR is not a hosting service and does not seek the protections of the DMCA safe harbor framework.
XtrkR displays information based on what you enter. The accuracy of all insights, scores, and analytics depends entirely on your input.
If you enable it, XtrkR can write certain sexual activity data to Apple Health, subject to Apple's terms. XtrkR does not read data from Apple Health.
If you enable backups, encrypted backup files are stored in your iCloud Drive, subject to your Apple ID terms. Those backups are AES-256-GCM encrypted with a password you set, and I cannot decrypt them.
To the maximum extent permitted by law, XtrkR is provided "as is" without warranties of any kind. I do not warrant that the app will meet your specific requirements, be accurate, or be error-free.
I am not liable for health decisions made based on app information, for data loss resulting from device failure, deletion, loss of access, or failed backups, or for the accuracy of geocoding, reminders, insights, or data written to Apple Health. To the maximum extent permitted by law, total liability shall not exceed the greater of (a) the amounts you have paid to De Nihil LLC through the App in the twelve months preceding the claim, or (b) fifty dollars ($50).
I will respond to valid legal process from the United States as required by law. The information I can provide in response to such process is limited by what De Nihil LLC actually holds.
Because XtrkR is designed to keep your records on your device, the data De Nihil LLC holds on its own systems is narrow. It generally consists of:
I do not operate servers that store your encounter logs, partner profiles, STI test records, medication tracking data, mood entries, photos, or any other content you enter into the app. I cannot produce that content because I do not hold it. iCloud Drive backups, if you enable them, are encrypted with a password only you hold; I cannot decrypt them. Apple Health entries, if you enable that integration, are governed by Apple's privacy practices and are not accessible to me.
If served with legal process, I will evaluate the request, respond to what is properly compelled, and — where the law permits — notify the affected user so they can object or take other action. I do not voluntarily share user information with third parties, and I do not sell or share data for advertising or marketing purposes. This section describes the architectural reality of what I can and cannot provide; it does not constitute a commitment to oppose or assist any specific legal process beyond what the law requires.
Contact me first so I can try to resolve any issue informally. Except for disputes relating to in-app purchases handled by Apple, any dispute arising out of or relating to XtrkR or these Terms will be resolved by binding individual arbitration, and not in court, except that either party may bring an individual claim in small claims court if it qualifies. You and I each waive any right to a jury trial and any right to participate in a class action or class arbitration. Arbitration will be administered by the American Arbitration Association under its applicable consumer rules. If any part of this arbitration provision is found unenforceable, the remaining portions will remain in effect to the fullest extent permitted by law.
I reserve the right to modify, suspend, or discontinue XtrkR (or any part of it) at any time. I am not liable to you or any third party for any modification, suspension, or discontinuation of the app. Because your records are stored locally on your device, discontinuing the app does not automatically delete data already stored there, but continued functionality may depend on your device, iOS compatibility, and whether you preserve your own backups or exports. If XtrkR is discontinued, Core purchasers retain use of any features that remain functional on their device and iOS version, but De Nihil LLC is not obligated to provide ongoing updates, compatibility maintenance, or support following discontinuation.
I may update these terms from time to time. Updated terms take effect when posted. Continued use constitutes acceptance.
